1. PIL 70/2015 is pending to dispose in Hon’ble Bombay High Court. 
2. The affidavit of Shri Dilip Prabhakar Gheware, the   Town   Planner   of   Mira   Bhayandar   Municipal Corporation has filed for opening of Playground to Public.
3. Google Map of PlayGround Reservation No 246 show that 711 Pre-Primary School is using Playground 246 for commercial purpose and made illegal encroachment on land.
4. No permission has been taken from Hon’ble Bombay High Court for construction of Electricity Power supply has made encroachment of more than 1000 Sqft of RCC room on Public Reserved Garden Plot.
5. Town Planning & other concerned officers will responsible for proceeding under criminal contempt of court of THE CONTEMPT OF COURTS ACT, 1971

My submission is with due respect and all humility, with no intention to cause hurt and injury to any individual and /or institution, but only in the interest of public at large. In the event, if my submissions is incorrect, I shall be obliged if your office can educate me by furnishing relevant documents in support. Without prejudice to my rights and contentions I submit as under.

Facts of the case :

1. I have filed RTI application on Mira Bhayandar Municipal Corporation for seeking information on MBMC Public Garden Reservation Plot 246.
2. PIO SHRI DILIP GHEWARE has replied on 03/12/2019 on details of area taken under custody of MBMC for Public Garden Reservation Plot 246 is only 14486.93 square meter out of 20000 square meter. (Exhibit-1)
3. PIO SHRI DILIP GHEWARE has replied on 06/12/2019 on details of area taken under custody of MBMC for Public Garden Reservation Plot 246 is 21641.68 square meter. (Exhibit-2)
4. PWD, MBMC SHRI DEEPAK KHAMBIT has provided documents in RTI which shows still some area has not been taken for development of garden. (Exhibit-3)
5. I have attached google satellite image of MBMC for Public Garden Reservation Plot 246. (Exhibit-4)
6. I have attached DP layout of MBMC for Public Garden Reservation Plot 246. (Exhibit-5)
7. Hence it proves that PIO SHRI DILIP GHEWARE has made a false document and provided under RTI act 2005.
8. Department enquiry shall be initiated against PIO SHRI DILIP GHEWARE.
9. Mira Bhayandar Municipal Corporation Officers, 
1. being a public servant, corruptly or maliciously makes or pronounces in any stage of a judicial proceeding, any report, order, verdict, or decision which he knows to be contrary to law, shall be punished with imprisonment under IPC. 
2. Disobeyed the direction of law to save and shield the offenders from prosecution and punishment, by denying information. Offence u/s 217, IPC.
3. Framed incorrect record and writing to save and shield the offenders from prosecution and punishment by denying information Offence u/s 218, IPC. 
4. Departmental action and disciplinary action against Mr. Santosh Jadhav as per GAD circular CRTI-2007/74/C.R.154/07/06 dt. 31.3.2008 for willfully and deliberately violating the proviso of GAD circular CIC 2016/ C.R. (178/16) VI dt. 1.2.2017.
5. Issued TDR without taking custody of land.
